Therefore, an unabridged broadcast on ARTE on the night of January 27th to 28th, 2022 caused great surprise for us too. The prosecutor is investigating
As the taz reports, the public prosecutor’s office in Baden-Baden has started criminal investigations. Above all, there is a violation of §131 of the Criminal Code, but also against the rules of the Youth Media Protection State Treaty. The investigation is directed against unknown. A TV station itself cannot be the target of criminal investigations. These must always be aimed at people.
According to the taz , these investigations are currently being carried out against unknown persons. The public prosecutor’s office should now try to find out who was responsible at ARTE for the fact that the banned horror film was shown in its entirety on TV and in the media library.
According to Section 131 of the Criminal Code, those responsible for broadcasting could face a fine, in the worst case even a prison sentence of up to one year. If there is no corresponding criminal record, such a sentence is regularly suspended on probation. That in the end someone even ends up in prison for broadcasting the horror film can therefore be ruled out.
